Det er jo det striden om det 22. tillæg har - ordlyden i teksten understøtter ikke din udlægning da den klart taler om at blive valgt til embedet, ikke overtage det.
"Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of President more than once."
Så teknisk set burde en tidligere præsident godt kunne overtage embedet efter at have fungeret som VP, såfremt POTUS dør under sin embedsperiode, såfremt de opfylder kravene til tillæg 12.
Men det er i sidste ende en vurdering der må tages af en domstol, det lader ikke til at være noget der blev taget højde for da tilføjelserne blev vedtaget. OG er ifølge Wiki ej heller en ny problemstilling:
